Jackknife Truck Accidents IF YOU WERE INJURED IN AN ACCIDENT, OUR LEGAL TEAM IS HERE TO HELP.

Valdosta Jackknife Truck Accident Attorneys

More Than 45 Years of Truck Accident Litigation Experience

Jackknife crashes require an investigation focused on truck mechanics, cargo risks, and evidence that can disappear within days. Studstill Firm, LLP represents people injured in these collisions, applying more than 45 years of serious truck accident litigation experience to questions of fault and financial recovery.

We’ve fought for Georgia injury victims since 1981 and recovered more than $81.5 million for injured clients. We examine how the tractor-trailer lost alignment, who controlled its operation and maintenance, and whether regulatory violations contributed to the crash.

How a Tractor-Trailer Jackknifes

A jackknife occurs when a trailer swings outward at the fifth-wheel coupling, the connection point between the tractor and trailer, until it forms a sharp angle with the cab. The trailer can sweep across several lanes, strike nearby vehicles, or suddenly block a driver’s path.

These crashes cause injuries and deaths nationwide. In 2020, jackknifing was recorded in 169 fatal large-truck crashes, approximately 1,000 injury crashes, and approximately 4,000 crashes involving property damage only. These national figures aren’t specific to Valdosta or Georgia, but they demonstrate the destructive potential of this crash mechanism.

What Causes Jackknife Truck Accidents in Valdosta?

Jackknifing can result from hard braking, excessive speed, poor weather, mechanical failures, or improperly secured cargo. A sudden loss of traction can cause the trailer to continue moving forward while the tractor slows or changes direction.

Our investigation may also examine distracted or intoxicated driving, driver fatigue, inexperience, traffic-law violations, overloaded cargo, and inadequate vehicle maintenance. We assess the full sequence of events rather than assuming one mistake caused the collision.

South Georgia truck traffic includes logging trucks carrying timber products, agricultural and poultry transport vehicles, and long-haul shipping trucks traveling the I-75 logistics corridor. The weight, movement, and securement demands of these loads can present distinct risks. We consider the relevant cargo hazards when investigating driver conduct, loading practices, equipment condition, and carrier oversight.

Who May Be Liable for a Jackknife Crash?

Responsibility may extend beyond the driver. Depending on the evidence, liable parties can include the trucking company, a cargo loading contractor, or a third-party maintenance provider.

Our attorneys investigate several sources of potential fault:

  • The truck driver: Driving decisions, fatigue, distraction, impairment, or traffic violations may have contributed to the loss of control.
  • The trucking company: A carrier may be responsible for its driver’s conduct or for negligent hiring, training, supervision, or safety practices.
  • The cargo loading contractor: Overloading or improper cargo securement may affect the trailer’s stability.
  • The maintenance provider: Faulty inspections or maintenance may leave braking, steering, or other mechanical problems unaddressed.

Drivers and motor carriers operating in Georgia must comply with Federal Motor Carrier Safety Administration rules governing hours of service, vehicle inspections, and cargo securement. Violations don’t automatically resolve liability, but they can provide important evidence of how the crash occurred and who bears responsibility.

Truck & Roadway Evidence Can Disappear Quickly

Trucking records can reveal how the vehicle was operated and maintained before impact. Electronic data may document driving and duty periods or vehicle operation, while company files can provide context about the driver, maintenance, and safety history.

Once retained, we promptly send a spoliation letter, a formal demand that relevant evidence be preserved. Our demand can cover electronic logging device data, engine control module records, driver logs, training records, maintenance files, and the driver’s accident and violation history.

Speed matters. Federal regulations generally require carriers to retain hours-of-service records for six months, and Georgia Department of Transportation traffic cameras generally don’t record or store footage at all, so it may not be available after a crash. Prompt action allows our attorneys to seek trucking and roadway evidence before routine deletion or overwriting occurs.

Compensation & Georgia Claim Deadlines

Our trucking attorneys can pursue compensation for medical expenses, lost wages, vehicle damage, and pain and suffering. When a collision is fatal, we can also pursue eligible funeral costs and a wrongful death claim on behalf of the appropriate family members.

Georgia generally allows two years from the crash date to file a personal injury lawsuit under O.C.G.A. § 9-3-33. Other circumstances can affect the deadline, so each claim should be reviewed promptly rather than treated as having an automatic two-year filing window.

Georgia also applies modified comparative negligence, which considers each party’s percentage of fault. An injured person can generally recover if that person is less than 50% responsible, although the recovery is reduced by the assigned percentage of fault. Valdosta truck accident lawsuits are generally handled in the appropriate Georgia court based on jurisdiction and venue.
